Approaching the human in the loop – legal perspectives on hybrid human/algorithmic decision-making in three contexts

Public and private organizations are increasingly implementing various algorithmic decision-making systems. Through legal practical incentives, humans will often need to be kept in the loop of such maintain human agency accountability, provide safeguards, or perform quality control. Introducing oversight results forms semi-automated, hybrid – where agents interact. Building on previous research we illustrate dependencies forming an impetus for policing, social welfare, online moderation contexts. We highlight further situate a wider environment data protection, constitutional administrative principles, as well contextual analysis principles. Finally, outline agenda capture decision-making, pointing go beyond doctrinal studies by adopting socio-technical perspectives empirical studies.
